The other night I handed the new Barnes and Noble HD+ to my son to see his reaction to one of the latest 9-inch tablets. He held it, played with the screen and said, “Which one is this?” I told him and he answered, “I can’t tell the difference anymore.” It’s true, with the sudden explosion of 7-, near-8-, 9- and 10-inch-plus tablets, it’s getting a little hard to tell which one is which — especially when many larger tablets look like their tinier siblings.


Barnes and Noble’s large-format (9-inch) HD-screen entry, the HD+, is a quite similar to the 7-inch Nook HD. However, with its somewhat sharper corners and far-reduced black-screen border, it’s also more similar in appearance to larger tablets such as the Amazon Kindle Fire HD 8.9. What sets the Nook apart visually is the trademark nook hole in the lower left-hand corner. It appears to serve no visible purpose, though you could hold the roughly 18-ounce tablet by that corner without too much stress on your hand. It is one of the lightest tablets on the market, although it’s thicker than the Google Nexus 10, Kindle Fire 8.9 and fourth-generation Apple iPad.

Nook HD+’s other distinctive feature is the physical “N” home button on the face of the device. It’s an attribute the Nook HD+ (and 7-inch Nook HD) share with the iPad. As I’ve said before, having that obvious “take me home” button on the front of the device is something I wish every tablet manufacturer would replicate.


Interface


Speaking of replicate, much of what is important and what you need to know about Barnes and Noble’s biggest tablet can be found in my review of the 7-inch Nook HD. The interfaces are exactly the same, so I won’t waste too much space recounting every bit of the Nook HD+ interface, which obscures any trace of Android 4.0, and is exquisitely usable.


The biggest difference between the Nook HD and the HD+ is screen resolution. The HD gets you 1440×900 pixels, while the HD+ offers 1920×1280, which is slightly more than the Kindle Fire HD 8.9’s 1920×1200. The latter two devices are almost the exact same size. By contrast, the competitors’ 7-inch devices are quite different because Amazon includes a front-facing camera, while Barnes and Noble does not include cameras on any of its tablets (if you plan on taking photos or video with your tablet, you can stop reading now). In the case of the Nook HD+, Barnes and Noble uses the space it saves on a camera for, it appears, 80 extra pixels of space. For the record, neither device beats the iPad’s 2048×1536 resolution.


Connectvity


Barnes and Noble also chose to leave out a cellular option from all of its tablets. Amazon, on the other hand, adds it in for the Kindle Fire HD 8.9 LTE. This is not as big of a deal as it seems since the world is filled with high-speed Wi-Fi. Still, if you plan to surf the web on your tablet while sitting on a train without another device to which to tether your HD+, look for products with the mobile broadband option, instead.


When it comes to connectivity, Amazon adds dual-band Wi-Fi to its HD Kindle Fires, while Barnes and Noble’s tablet remains single band. I’ve tested both devices in the most stressful situation -– streaming HD video -– and the difference is negligible.


Using It


Barnes and Noble Nook HD+’s profile-centric interface remains one of the best on the market. There is no learning curve; you simply drag your profile image to the unlock icon, and you have access to the large and uncluttered interface that features a carousel (which like the Kindle is a hodge-podge of disparate icons), your library and some recently used apps. Persistent menu items include the Library, Apps, Web, email and Shop. The screen also includes “your Nook Today,” which, along with the weather, is a place for Barnes and Noble to push shopping options based on your interests.


As you would expect, reading books and magazines is a pleasurable experience, especially on this larger screen. Magazines such as Esquire look great and, yes, Barnes and Noble still employs the animated page turn (though I don’t know for how much longer). Email and Web browsing are solid, and I prefer Barnes and Noble’s web solution to Amazon’s home-grown Silk browser, which crashed too often for my taste.


Social integration is fairly good on the Nook HD+. When I installed the Twitter client, it became one of my options for social sharing. That said, the app looks like it would be more at home on a small-screen smartphone than on the HD+’s 9-inch display. For Facebook, I opted for the web interface, which looks too tiny in portrait mode, but just right in landscape.


Movies and Music


I had no trouble buying, renting and streaming HD-quality movies such Arthur Christmas, and Netflix worked smoothly. Barnes and Noble, however, lacks its own streaming option. If you pay $ 75 a year for Amazon Prime, you get access to a vast library of streaming content. Both devices will let you play HD content on your big-screen TV, though they do it in slightly different ways.


Amazon’s Kindle Fire HD 8.9 comes complete with a mini-HDI-out port, and can accommodate a mini-to-standard HDMI cable (not included), so I could watch the HD content on my big-screen TV. The Nook HD+ lacks an HDMI port, but you can buy a $ 39 adapter (with an HDMI cable), which plugs into the tablet’s 30-pin port, to do the same thing.


I still prefer the Kindle HD platform for music since Amazon’s music services are more deeply integrated into the device and its cloud-based storage offering. On the Nook HD+ you have to start by finding the music service under Apps. If Barnes and Noble is serious about music, it should be on the main menu. Worse yet, if you open the Music app, it offers no instruction on how to fill your music library. You have to add tunes via your computer, by connecting to your PC with the proprietary cable or through the Micro SD slot where you can add more storage or place, say, an entire library of songs.


If you have a Rhapsody Account, you can use it to manage your music needs on the Nook HD+.


I almost never use my large tablet for music (that’s a job for my iPhone or iPod), so I don’t miss the rich music capabilities as much as some others likely would.


Apps and Performance


Like Amazon, Barnes and Noble curates its app library, which generally makes it safe and usable. The key apps, such as Netflix, Twitter, Dropbox, MobiSystems’ OfficeSuite, FlipBoard and Evernote, are all there.


I found some games on there, too, such as the Angry Birds Series and Cut the Rope. On the other hand, Barnes and Noble has very few action games. This may be because, while it’s running the same Texas Instruments Dual core 4470 CPU as the Kindle Fire HD 8.9, it doesn’t offer the same quadcore graphics processing power as Apple’s fourth-generation iPad.


Amazon actually includes the GPU-hungry Asphalt 7 in its app library, but the game does not look particularly good on the Kindle Fire HD 8.9. Obviously, Barnes and Noble chose not to take that risk.


Price


At $ 269 for the 16 GB model (I tested the $ 299 32 GB option), Barnes and Noble’s Nook HD+ is one of the most affordable large-screen tablets on the market — that price even includes the AC adapter. Amazon’s Kindle Fire HD 8.9 costs $ 299, but does not include the charger, and adds subsidizing sleep-screen ads. A 16 GB Wi-Fi-only fourth-generation iPad starts at $ 499.


Obviously, the iPad is more powerful, has a higher resolution and two cameras, while the Kindle, which also includes a camera, offers powerful Dolby stereo speakers (Nook HD+ has ones with decent volume) and unlimited cloud-based storage for your Amazon content. But if those features don’t matter to you, and you’re looking for an attractive, large-screen, light-weight, fun, effective and very affordable tablet from a company that knows a thing or two about good content, you can’t do better than the Nook HD+.

Samsung files redacted copy of Apple-HTC deal in U.S. court












(Reuters) – Lawyers for Samsung Electronics Co Ltd filed a redacted copy of a 10-year patent licensing agreement between Apple Inc and Taiwan’s HTC Corp in a U.S. court late on Wednesday following a judge’s order.


The Korean electronics company had earlier filed a motion to compel Apple — with which it is waging a bitter legal battle over mobile patents across several countries — to reveal details of a settlement that was made with HTC on November 10 but which have been kept under wraps.












The court last month ordered Apple to disclose to Samsung details of the legal settlement that the iPhone maker reached with HTC, including terms of the 10-year patents licensing agreement.


Legal experts say the question of which patents are covered by the Apple-HTC settlement, and licensing details, could be instrumental in Samsung’s efforts to thwart Apple’s subsequent quest for a permanent sales ban on its products.


The redacted copy excludes key specifics such as the royalty payments HTC would have to make to Apple for using some of the U.S. company’s patents. Also excluded are details of some of HTC’s covered products that were part of the licensing deal.


The court order had stated that “only the pricing and royalty terms of license agreements may be sealed.”


However, Samsung lawyers said in the filing that they had withheld a few other details of the licensing agreement as requested by Apple and HTC.


As per the Apple-HTC agreement, the licenses do not include Apple’s design patents, according to a filing made with the District Court of Northern California.


Apple and HTC also agreed to fully paid-up, royalty-free, non-exclusive, non-transferable, non-sublicensable licenses to certain of the other’s patents.


Apple has agreed not to initiate legal action over some of HTC’s covered products. The details of the products were not disclosed.


The copy of the Apple-HTC deal filed with the court “incorporates redactions HTC requested and the redactions Apple requested, which are a subset of HTC’s redactions. Samsung takes no position on whether the redactions are appropriate at this time,” Samsung’s lawyers said in a filing.


If all the Apple patents are included — including the “user experience” patents that the company has previously insisted it would not license — it could undermine the iPhone maker’s efforts to permanently ban the sale of products that copy its technology.


In a previous court filing, Samsung argued that it was “almost certain” that the HTC deal covered some of the patents involved in its own litigation with Apple.


The case in U.S. District Court, Northern District of California, is Apple Inc v. Samsung Electronics Co Ltd et al, No. 11-1846.

Habla el hombre que definió qué significa ser un hacker












“Soy un hacker.” La frase la pronuncia, sin titubeos, Pekka Himanen, un finlandés de 39 años que publicó, en 2001, La ética del hacker y el espíritu de la era de la información , un libro fundacional en su análisis de lo que significa la tecnología moderna en nuestra sociedad, y la influencia que tendrán los hackers en la sociedad futura.


La entrevista está por comenzar. El punto de encuentro es un hotel céntrico de la ciudad de Buenos Aires, pero en lugar de recibirnos en el salón exclusivo reservado con este fin, el filósofo Himanen (recibido en la universidad de Helsinki a los 20 años) prefiere reunirse en el café del hotel, rodeado de gente y atento a su entorno.












Este hombre, que hoy es profesor en la Universidad de Arte y Diseño de Helsinki, y profesor visitante de la Universidad de Oxford y el Instituto IN3 de Barcelona, y miembro del Instituto Helsinki para la Tecnología de la Información (HIIT) es autor, también, de El Estado del bienestar y la sociedad de la información: el modelo finlandés , que realizó junto con el sociólogo español Manuel Castells.


Himanen llegó a nuestro país invitado por la Universidad Nacional de San Martín, la Universidad Diego Portales y por la Fundación OSDE, pero además de esta convocatoria también lo trajo una de sus grandes pasiones: la investigación. “Estamos estudiando, junto con Manuel Castells, qué tipo de modelo de desarrollo nuevo se necesita después de la crisis mundial. Me refiero a un modelo de desarrollo económico combinado con desarrollo humano. Creo que es fundamental combinar una economía sustentable con el bienestar sustentable”, sostiene al comenzar la entrevista. Según cuenta el filósofo, Argentina es parte de un gran estudio que está llevando a cabo en distintos países de América latina, Asia, África, Estados Unidos y Europa.


¿Usted se considera un hacker?


Sí, claro que sí. Para mí un hacker es alguien creativamente apasionado por lo que hace y quiere hacerlo con otros. No necesariamente tiene que tener que ver con las computadoras, se puede ser hacker del conocimiento o de cualquier otro campo. Es importante decir que utilizo el término hacker en el sentido original del término, que no quiere decir delincuente informático.


¿Y usted es hacker en qué área o con qué especialización?


Yo diría en la filosofía, investigación y quizás en la vida.


¿Cómo es eso?


La etica del hacker es un libro que también habla sobre la filosofía de vida, es decir, uno tiene que preguntarse a sí mismo: ¿cuál es mi pasión creativa? ¿Qué es lo que le da significado a mi vida? Esas son grandes preguntas que todos deberíamos considerar.


Popularmente el término hacker tiene una mala connotación pero según usted explica, es un error. En su libro menciona otro término: cracker ¿Cuál es la diferencia entre ambos?


Hacker quiere decir que la persona es creativamente apasionada por lo que hace, y lo quiere realizar con lo que yo denomino “interacción enriquecedora”, es decir con otras personas. Cracker, en cambio, es el delincuente informático, la persona que ingresa en los sistemas informáticos y esparce virus, entre otros delitos.


¿Por qué, entonces, los hackers son considerados delincuentes?


Todo comenzó en los medios de comunicación, en los inicios del software. Por aquel entonces los medios tomaron la palabra hacker y comenzaron a utilizarla como sinónimo de delincuente informático para hacerlo más atractivo y dar impacto en sus noticias, pero la palabra hacker no tiene nada que ver con la delincuencia informática.


Según su libro los hackers informáticos ponen a disposición gratuita de los demás su creación para que la utilicen, pongan a prueba y la desarrollen. ¿Cómo un hacker se transforma en Bill Gates? En otras palabras, ¿cómo se transforma un hacker en un hombre de negocios?


La ética hacker es una ética de trabajo creativa en la era informática que reemplaza lo que Max Weber describió como “ética de trabajo industrial” pero después depende de cuán abierto es uno en el desarrollo de otras cosas. No necesita ser cerrado para ser un éxito, por ejemplo Linus Torvalds está a favor de la apertura total y también ha tenido mucho éxito. Internet corre en Linux, tres de cada cuatro smartphones en el mundo corren en Linux, porque Android está basado en Linux. Pero más allá de eso no hay contradicciones, porque uno puede tener pasión creativa como empresario. Lo importante es dar suficiente nivel de apertura.


¿Cómo ayudan a la sociedad los hackers y las redes sociales en situaciones de conflicto, injusticia social o cuando no hay libertad de expresión?


En situaciones como la guerra de Kosovo o en la Primavera Árabe -levantamientos populares de países árabes realizados entre 2010 y 2012- la difusión de lo que estaba pasando fue a través de las redes sociales. Y es muy importante tener en cuenta que las redes sociales tienen un impacto en la vida real. Si pensamos en la Primavera Árabe, por ejemplo, algunos de los peores dictadores que nosotros pensamos que nunca dejarían el poder, colapsaron. Y las redes sociales colaboraron mucho en la caída de estos dictadores porque la Primavera Árabe estuvo organizada a través de Internet. También en Europa se produjeron hechos similares. Las redes sociales tuvieron gran protagonismo en el movimiento de “Los Indignados”, que produjeron cambios políticos en España y en Grecia.


¿Le parece que lo que escribió hace más de una década sigue vigente?


Sí. El libro es más actual ahora. Si uno toma, por ejemplo, el capítulo de open source o de código abierto, su utilización ha crecido exponencialmente si tenemos en cuenta que Internet corre en software en código abierto y se diseminan en varios equipos como teléfono, grabadores digitales y televisores. Probablemente uno no se de cuenta que está utilizando código abierto, pero todos lo estamos utilizando. En cuanto al trabajo empresarial, la nueva ética de pasión creativa enriquecedora está impulsando al Silicon Valley.


¿Cómo ve a la sociedad futura?


Creo que la gran pregunta es lo que hoy estamos investigando en el proyecto que estoy realizando, donde nos damos cuenta que el viejo modelo de desarrollo ha llegado a su fin y ahora tenemos que replantear las prácticas grandes en la economía, la sustentabilidad ecológica. Creo que vamos a necesitar del potencial completo de la cultura de la creatividad y hemos de desarrollar esa nueva forma de bienestar sustentable, especialmente la sustentabilidad ecológica. Debemos tener en cuenta que el planeta no tiene problema en cuanto al cambio climático, puede continuar sin nosotros, pero nosotros no podemos continuar sin el planeta.


Por último, ¿qué trata de decirnos con su libro?


Para mí la clave es que todos debemos preguntarnos: ¿cuál es mi pasión creativa, cuál es mi propósito significativo en esta vida?

Student group to go to court over Facebook privacy policy












VIENNA (Reuters) – An Austrian student group plans to go to court in a bid to make Facebook Inc, the world’s biggest social network, do more to protect the privacy of its hundreds of millions of members.


Campaign group europe-v-facebook, which has been lobbying for better data protection by Facebook for over a year, said on Tuesday it planned to go to court to appeal against decisions by the data protection regulator in Ireland, where Facebook has its international headquarters.












The move is one of a number of campaigns against the giants of the internet, which are under pressure from investors to generate more revenue from their huge user bases but which also face criticism for storing and sharing personal information.


Internet search engine Google, for example, has been told by the European Union to make changes to its new privacy policy, which pools data collected on individual users across its services including YouTube, gmail and social network Google+, and from which users cannot opt out.


Europe-v-facebook has won some concessions from Facebook, notably pushing it to switch off its facial recognition feature in Europe.


But the group said on Tuesday the changes did not go far enough and it was disappointed with the response of the Irish Data Protection Commissioner (DPC), which had carried out an audit after the campaign group filed numerous complaints.


Facebook, due to hold a conference call later on Tuesday to answer customer concerns about its privacy policy, said its data protection policies exceeded European requirements.


“The latest Data Protection report demonstrates not only how Facebook adheres to European data protection law but also how we go beyond it, in achieving best practice,” a Facebook spokesman said in an emailed comment.


“Nonetheless we have some vocal critics who will never be happy whatever we do and whatever the DPC concludes.”


LOSING PATIENCE


Europe-v-facebook founder Max Schrems, who has filed 22 complaints with the Irish regulator, said more than 40,000 Facebook users who had requested a copy of the data Facebook was holding on them had not received anything several months after making a request.


“The Irish obviously have no great political interest in going up against these companies because they’re so dependent on the jobs they create,” Schrems told Reuters.


Gary Davies, Ireland’s deputy data protection commissioner, denied Facebook’s investment in Ireland had influenced regulation of the company.


“We have handled this in a highly professional and focused way and we have brought about huge changes in the way Facebook handles personal data,” he told Reuters.


Schrems also questioned why Facebook had only switched off facial recognition for users in the European Union, even though Ireland is the headquarters for all of Facebook’s users outside the United States and Canada.


Facebook is under pressure to reverse a trend of slowing revenue growth by selling more valuable advertising, which requires better profiling of its users.


Investors are losing patience with the social network, whose shares have dropped 40 percent in value since the company’s record-breaking $ 104 billion initial public offering in May.


Last month, Facebook proposed to combine its user data with that of its recently acquired photo-sharing service Instagram, loosen restrictions on emails between its members and share data with other businesses and affiliates that it owns.


Facebook is also facing a class-action lawsuit in the United States, where it is charged with violating privacy rights by publicizing users’ “likes” without giving them a way to opt out.


A U.S. judge late on Monday gave his preliminary approval to a second attempt to settle the case by paying users up to $ 10 each out of a settlement fund of $ 20 million.


Europe-v-facebook said it believed its Irish battle had the potential to become a test case for data protection law and had a good chance of landing up in the European Court of Justice.


Schrems said the case could cost the group around 100,000 euros ($ 130,000), which it hoped to raise via crowd-funding – money provided by a collection of individuals – on the Internet.

The Aakash2, the second generation of the monumental, ultra-cheap tablet from Indian manufacturer DataWind, arrived in the U.S. Wednesday, with a welcome at the U.N. Headquarters in New York.


DataWind is hoping to prove to the tech and development communities that the $ 40 Aakash2 is faster than its predecessor, the original Aakash, which was much-criticized for its glacial processor.

You may be wondering what exactly you can put in a tablet that sells for just $ 40.41. The 7-inch Android-powered device has 512 MB of RAM, a 1 Ghz processor, 4 GB of flash memory, a multi-touch capacitative screen, front-facing camera, an internal microphone and speakers. The Aakash2 includes a USB hub, an adapter cable, a wall charger and a 12-month warranty.


Sunseet Singh Tuli, DataWind’s CEO and the visionary behind the tablet, points out that Aakash2 wasn’t conceived for the same demographic as the iPad. It’s developed out of the requisite “frugal innovation” that guides India and the developing world.


“Frugal innovation isn’t about creating an iPad killer, it’s about creating an iPad for him,” said Tuli, pointing to a presentation slide of a lower-class man who’s primary motivation is to receive an education. “This is not a straight commerce effort — it’s an educational effort.”


Even the tablet’s name — Aakash, which means sky in Hindi — references that it was created to awaken students’ potential. The government of India has committed to subsidize 50% of the cost of the device for students, making it available for roughly $ 20.


According to DataWind, the technological breakthrough of the Aakash2, which is why the device can be made so inexpensively, is twofold. First, much of its memory and processing power is transfered to backend servers. Second, the parallel processing environment speeds the user experience in remote areas and congested networks.


The Aakash2 also eliminates hardware features deemed unnecessary for the target audience, such as bluetooth and the HDMI interface. It uses open source software to cut costs, as well.


“This tablet seeks to empower the world’s neediest and bridges the digital divide within our society,” said Hardeep Singh Puri, India’s permanent representative to the U.N. at the launch event. “To us, Aakash2 is the epitome of such high end innovation and excellence.”


The Aakash to was designed and developed in Canada, though it was conceived, assembled and programmed in India. DataWind and the Indian government have received criticism because the process is not entirely domestic, though both said they are committed to moving more of the production process to India when cost allows.


The Indian government has committed to equipping all 220 million students in the country with low-cost computing devices and Internet access over the next five years. To put that number in perspective, just 250,000 tablets were sold in India in 2011. It will cost $ 1.6 billion per year at the rate of equipping 40 million students for each of the next five years. The national government has committed to covering half the cost — $ 800 million per year — and will count on state governments and institutions to cover the remaining 50% of costs. Though it sounds like a daunting figure, $ 800 million is only 5% of India’s annual education budget.


“More and more schools in some of the most impoverished areas are using technology, text messaging and mobile applications to enhance the quality of education and open new doors,” said U.N. Secretary General Ban Ki-moon on Wednesday. “Our challenge is to leverage the power of technology and bridge the digital divide.”


During Wednesday’s event at the U.N., Tuli presented Ki-moon with an Aakash2 tablet for each of the U.N. ambassadors.


Not surprisingly, other countries throughout the developing world have noticed the Aakash tablet’s potential. Thailand, Turkey, Sri Lanka, Bolivia, Honduras, Nicaragua, Brazil and Panama have all expressed interest in bringing the low-cost tablet to their students.


“The next arms race is to equip our children with knowledge and information,” Tuli said.


If you’re wondering when you can get your hands on an Aakash2 in the U.S., DataWind plans to begin selling the device in the U.S. in early 2013.

EBay’s double tax base prompts calls for investigation












LONDON (Reuters) – Britain and Germany may have missed out on a combined $ 1 billion in sales tax since online marketplace eBay picked a tiny Luxembourg office as its base for EU sales, a shift that lawmakers say should now be investigated.


EBay’s nomination of Luxembourg unit eBay Europe Sarl – with a staff of nine – as its provider of services to EU clients allows it to charge customers in Europe a low rate of sales tax, often known as Value Added Tax, helping it to compete against rivals.












However, the unit doesn’t actually receive the money from sales. Instead, eBay said it continues to channel revenues through a Berne-based unit, allowing the company also to benefit from what Swiss tax lawyers say is the most competitive corporate income tax regime in Europe.


EU rules allow companies to establish subsidiaries in Luxembourg and levy VAT at Luxembourg’s low VAT rate on sales to customers across the bloc.


However, the rules also allow individual EU taxmen to challenge any claim to Luxembourg residence, and the right to charge Luxembourg VAT, in their domestic courts, if the taxman feels a Luxembourg-based subsidiary does not have sufficient staff or assets to support its claim to be the true supplier of goods or services.


Tax experts say eBay’s arrangement, which appears to give eBay the best of both income and sales tax worlds, could be open to challenge, and lawmakers in the UK and Germany want their taxmen to investigate.


“I hope that HMRC (UK tax authority Her Majesty’s Revenue and Customs) takes note … and takes prompt action,” said Margaret Hodge, member of parliament and chairman of the Public Accounts Committee (PAC), which monitors government finances.


“I will be seeking assurance that they are, next time we take evidence from HMRC,” she added. Officials from HMRC are due to testify to the PAC in early December as part of the committee’s investigation into tax matters.


Sven Giegold, member of the European Parliament for Germany’s Green Party, said he wanted the German tax authorities to “have a very critical look at this”.


It is common for companies to seek to reduce their tax bills, and a number of multinationals have established bases in Luxembourg so they can charge customers lower levels of VAT.


EBay said HMRC was aware of all its tax arrangements and that it was confident it met all its tax liabilities in the UK and elsewhere.


“In all countries and at all times, eBay is fully compliant with national, EU and international tax rules (including the OECD) including the remittance of VAT to the appropriate authorities,” an eBay spokesman said in an emailed statement.


The UK, German, French and Luxembourg tax authorities declined to comment on eBay, citing rules on taxpayer confidentiality.


LOWER THRESHOLD


Big companies’ tax practices have risen to the top of the political agenda in Europe in the past year, with lawmakers growing increasingly frustrated with the way in which companies such as search engine company Google pay almost no income tax in countries where they have billions of dollars in sales.


The companies escape liability for income taxes in countries like the UK by arguing the value created by their business, and therefore the location where the profit should be realized, is not the place where the customer resides, but rather in the location where the intellectual property underpinning the product or service is based.


Chas Roy-Chowdhury, head of taxation at the Association of Chartered Certified Accountants, said this was a valid economic argument and that if, for example, HMRC wants to claim more income tax from Google, it has to prove the company is generating more value in the UK than it is declaring.


This would require a thorough deconstruction of its business model and supply chain.


However, it is easier to establish liability to VAT, since this tax hinges simply on the location of the buyer and seller.


“The threshold is lower,” said Simon Newark, head of VAT at accountants UHY Hacker.


“There are a lot more aspects for HMRC to challenge in VAT than in direct (income) tax.”


For tax purposes, the EU deems eBay’s online platform an “electronically supplied service”, a category that also covers e-Books and music downloads.


Under EU rules, suppliers of such services based within the bloc are supposed to charge EU customers VAT at the rate prevailing in the country where the supplier is based.


A number of suppliers of electronic services, including Amazon.Com Inc and Apple Inc’s iTunes have established European headquarters in Luxembourg to enable them to charge customers lower VAT rates than prevail in their customers’ countries.


Luxembourg has traditionally charged the lowest standard VAT rates in the European Union. Its 15 percent rate compares with rates of 19-25 percent in most other EU members.


By charging customers VAT at Luxembourg’s rate eBay is better able to compete with rivals based elsewhere in the EU, such as Britain’s eBid, which must charge customers VAT at the standard UK rate of 20 percent.


However, to be entitled to charge Luxembourg rates, a company has to be able to prove in British, German or EU courts that it is genuinely based in the Grand Duchy.


Companies selling to EU customers from outside the EU – as eBay was until the 2007 nomination of eBay Europe Sarl as supplier to EU clients – must charge European customers VAT at the rate prevailing in the country where the customer resides, and to pay that VAT to the taxman in the customer’s country.


There is no definitive checklist that determines the true base of a company and any decision by a national court can be challenged in the European Court of Justice. In the UK, HMRC said it approached the matter on a case-by-case basis, and disputes are often resolved in court.


“HMRC will challenge any arrangements where it is claimed that supplies are made from a particular country but the business does not have the necessary resources to make those supplies,” a spokesman said.


EUROPE EXPANSION


EBay, which is headquartered in San Jose, California, moved into Europe in 1999 when it established eBay International in Berne. Switzerland’s low income tax regime for foreign companies was highly beneficial for the auction site. “We do have a very favorable international tax structure,” then-Chief Financial Officer Rajiv Dutta told analysts in 2002 when asked how the company managed to pay such low taxes on its non-U.S. income.


The Swiss base also meant, initially, that the company didn’t have to charge EU customers VAT. But in 2003, Brussels changed the rules, which forced eBay to charge EU sellers on its platform VAT based on their residence. The VAT gathered was remitted to the tax authority in the customer’s country.


Not all customers are charged VAT. Most medium-sized and big businesses are legitimately exempted from paying VAT on some purchases, such as eBay seller fees.


EBay’s Swiss-based European public relations head declined to say what portion of its EU customers were liable to be charged VAT. James Cordwell, equities analyst at Atlantic Equities, estimated that such customers accounted for 40-50 percent of sales in Europe.


Since the 2007 creation of its Luxembourg operation, eBay has had German fee revenues of $ 6.1 billion and UK revenues of $ 5 billion, its annual accounts show.


If the services were supplied from Switzerland or another non-EU country, and assuming only half of customers should have been charged VAT, EU rules would have obliged eBay to collect $ 580 million in VAT for the German taxman and $ 500 million in VAT for HMRC since 2007.


EBay’s entitlement to charge Luxembourg VAT on sales and to pay this to the Luxembourg taxman rests on being able to prove in court that eBay Europe Sarl is the provider of services to EU clients.


But despite German and UK fee income of $ 3.1 billion last year, eBay Europe Sarl recorded turnover of only 5 million euros in 2011.


John Hemming, an MP with the Liberal Democrats, the junior partner in the British coalition government, said the fact eBay’s sales revenues did not go through the Luxembourg unit undermined the claim that it was the true provider of services to EU clients.


“If it’s a real transaction, you would expect the money to pass with it, and not pass someplace else,” he said.


Rather than going to Luxembourg, the money generated from customers continues to go to Berne-based eBay International AG, a spokeswoman said.


When Reuters visited in mid November, staff at the Luxembourg office, just opposite the central post office, declined to discuss what operations the unit conducted for eBay.


A spokesman later said the office conducted activities including billing, data privacy, contracting, regulatory, management and some customer services operations.


By contrast, Amazon and iTunes do report their sales of ebooks and music downloads to EU customers through their Luxembourg units.


Prem Sikka, professor of accounting at Essex University, along with Newark and Roy-Chowdhury said a cash trail through a unit was one of the key factors used as evidence that the unit was the true supplier of a service.


UK and German tax authorities could argue that the shift in eBay’s supply base to Luxembourg from Berne was therefore not genuine. If successful, they could claim back the VAT lost.


EBay declined to say why it channeled sales through Switzerland. Tax advisors say the country can still offer some companies lower tax rates than other European low-tax jurisdictions such as Ireland and Luxembourg.


Indeed, EBay’s closest rival Amazon, which channels about half its non-U.S. earnings through Luxembourg, reported average income tax on overseas earnings of 6 percent in the past four years. EBay paid just 3 percent over the same period.

RIM stock rises after Goldman Sachs upgrade












TORONTO (AP) — Research In Motion rose Thursday after Goldman Sachs upgraded the phone maker’s shares, saying there’s a “30 percent chance” RIM‘s much-delayed BlackBerry 10 smartphones will be a success.


THE SPARK: Goldman Sachs analyst Simona Jankowski lifted RIM to “Buy” from “Neutral,” the latest analyst to voice a slightly more optimistic view for the troubled company. Goldman lifted its 12-month price target to $ 16 from $ 9.












THE BIG PICTURE: RIM was once Canada’s most valuable company, with a market value of more than $ 80 billion in 2008, but shares have sunk due to ground lost to Apple Inc.‘s iPhone and phones running Google Inc.‘s Android system.


Now the company’s new BlackBerrys, expected sometime after Jan. 30, are considered critical to its survival. The new system includes a touch screen and the apps experience that customers now expect.


THE ANALYSIS: Jankowski noted positive early reviews for the new operating system and broad-based support by carriers who are looking to sell a third operating system beyond Google’s Android and Apple’s iOS.


She predicted that RIM will become profitable in the year ending in February 2014. Analysts polled by FactSet expect a loss. Still, she expects RIM to revert to a loss the next year.


Last week, National Bank Financial Kris Thompson increased his price target to $ 15 from $ 12, while Jefferies analyst Peter Misek doubled his price target from $ 5 to $ 10, saying the BlackBerry 10 operating system has a 20 to 30 percent chance of succeeding.


SHARE ACTION: Shares of Research In Motion added 67 cents, or 6.4 percent, to $ 11.77 in midday trading on the Nasdaq. The stock is up 78 percent since late September — but it’s down 23 percent this year through Wednesday’s close, and has lost more than 90 percent from its 2008 high.

The cable network announced Thursday that the gaming extravaganza’s previous emcees would join “The Avengers” star and four-time VGAs host Samuel L. Jackson at next week’s show.












Previous hosts Zachary Levi, Snoop Lion, Jack Black and Neil Patrick Harris are set to appear at the 10th annual ceremony.

U.S. for-profit colleges spend big on marketing while slashing other costs












(Reuters) – Google‘s biggest advertiser is neither a bank nor a retailer.


It’s the for-profit University of Phoenix, which has recently been spending nearly $ 400,000 a day on ads, more than any financial firm or retailer, the traditional big spenders on online advertising, according to search analytics firm SpyFu.












That kind of spending may seem surprising coming from a college, but marketing has become vital for the university and its for-profit rivals as enrollments plummet and they fight back against a host of criticisms, including low job-placement rates.


Colleges such as University of Phoenix, the industry leader owned by Apollo Group Inc, will not only have to boost enrollments to reverse their fortunes, analysts say. They will also need to consider cutting tuition fees as well as continue to slash costs and take market share from rivals.


“I have witnessed several versions of this cycle but none as extreme as this,” said Trace Urdan, an analyst with Wells Fargo Securities, who has been covering the U.S. for-profit education industry for about 15 years.


“We are going to see more pointed efforts at marketing and more price competition in an effort to try to capture more market share both from each other as well as from traditional schools,” Urdan said.


Operators of other for-profit colleges, whose ranks include the Washington Post Co’s Kaplan business, DeVry Inc and ITT Educational Services Inc, are also boosting their spending on marketing and are among the 25 biggest advertisers on Google.


But no one is spending like the University of Phoenix, which doubled its spending on Google ads to about $ 380,000 per day on average between October 12 and November 12, compared with $ 170,000 a day in the previous month, according to SpyFu.


Increased marketing alone will not be enough to fatten fast-shrinking profit margins and increase enrollments, however. Lower tuition fees and increased specialization of the type of programs offered, along with further streamlining of operations, will also be necessary, analysts say.


Industry bellwether University of Phoenix, which offers courses at about 230 campuses as well as online, announced plans last month to shut about half its locations and cut 800 jobs in order to save about $ 300 million a year by 2014.


New enrollments in the Apollo system are down nearly 50 percent in the past two years. As of August 31, enrollment totaled about 328,000.


Career Education Corp, which owns American InterContinental University and the Le Cordon Bleu colleges, and Lincoln Educational Services Corp have also announced closures.


LOW-COST MODEL


The $ 25 billion industry, which typically serves adults looking for a career change or a program to enhance job skills, is reeling after government investigations revealed fraud related to financial aid, worryingly high student debt loads and low rates of graduation and job placement.


“Many for-profit colleges make decisions that prioritize their bottom line, even when those decisions limit their students’ opportunities for academic success,” a U.S. Senate report said earlier this year.


Tuition fees, and therefore profits, is one area under pressure as potential students need to be convinced to take out loans in an uncertain job market.


Apollo, whose stock has lost about 65 percent of its value this year, implemented a tuition freeze earlier this year and promised students it will not increase prices through the course of their programs.


Apollo is also looking at different cost models, with a view to serving segments of the population that it cannot serve with current University of Phoenix tuition prices.


“We have certainly seen a lot more competition at the lower end of the price scale, and that’s something we are focusing on,” Apollo spokesman Mark Brennar said, while declining to offer specifics.


Wells Fargo’s Urdan said it is likely that Apollo wants to compete in the low-cost end of the market by building a second brand, which it would likely do by acquiring another college rather than starting from scratch.


As colleges lower their revenue base by cutting tuition fees even as they spend more on marketing, lower margins could become the norm, analysts say. That has spooked investors already worried about sliding enrollments.


The S&P 1500 Education Services index has lost three-quarters of its value since April 2010, including a 50 percent decline in 2012.


Some for-profit colleges already differentiate themselves in the crowded higher-education market by offering programs in a particular field or by targeting students of a particular background, and that trend could accelerate.


American Public Education, for example, is known for enrolling those who work in the military and public services, while Universal Technical Institute offers programs related to the automotive industry.


For-profit colleges play up their links to employers to attract students who may otherwise opt for traditional or community colleges, said Rob Lytle, head of the education practice at advisory firm Parthenon Group.


“They are about getting people workforce employability skills, and I think they are going to be focusing tighter on that,” said Lytle.

Card firms’ block on WikiLeaks did not break rules: EU












BRUSSELS (Reuters) – A block on processing donations for WikiLeaks by Visa Europe and other credit card companies is unlikely to have violated EU anti-trust rules, the European Commission said on Tuesday.


DataCell, a company that collected donations for WikiLeaks, complained to the Commission about Visa Europe, MasterCard Europe and American Express Co after they stopped processing donations for WikiLeaks in December 2010. Their decisions followed criticism by the United States of WikiLeaks’ release of thousands of sensitive U.S. diplomatic cables.












“On the basis of the information available, the Commission considers that the complaint does not merit further investigation because it is unlikely that any infringement of EU competition rules could be established,” said a spokesman for the Commission, the EU executive.


He added, however, that the Commission would look at new information from DataCell before taking a final decision.


WikiLeaks founder Julian Assange has been staying in Ecuador’s embassy in central London since June to avoid extradition to Sweden to face rape and sexual assault allegations.


Assange said there were no lawful grounds for the card companies’ actions, which he said had cost Wikileaks 95 percent of its revenue and threatened his organization’s existence.

Facebook not so fun with a click from boss or mum












LONDON (Reuters) – Posting pictures of yourself plastered at a party and talking trash online with your Facebook friends may be more stress than it’s worth now that your boss and mum want to see it all.


A survey from Edinburgh Business School released on Monday showed Facebook users are anxious that all those self-published sins may be coming home to roost with more than half of employers claiming to have used Facebook to weed out job candidates.












“Facebook used to be like a great party for all your friends where you can dance, drink and flirt,” said Ben Marder, author of the report and fellow in marketing at the Business School.


“But now with your Mum, Dad and boss there, the party becomes an anxious event full of potential social landmines.”


On average, people are Facebook friends with seven different social circles, the report found, with real friends known to the user offline the most common.


More than four-fifths of users add extended family on Facebook, a similar number add siblings. Less than 70 percent are connected to friends of friends while more than 60 percent added their colleagues online, despite the anxiety this may cause.


Facebook has settings to control the information seen by different types of friends, but only one third use them, the report said.


“I’m not worried at all because all the really messy pics – me, drunken or worse – I detag straight away,” said Chris from London, aged 30.


People were more commonly friends with former boyfriends or girlfriends than with current ones, the report also found.

Once you launch the app, Instead walks you through three steps on how it works: pick something to give up – that second cup of coffee, for example – choose how much to give, and then select a non-profit to which to donate. Tap on the “About” button, select “Donation Transparency,” and the app explains exactly how your money is parceled out: 95 percent of your donation goes to the charity you select, and the remaining 5 percent goes to credit and debit processing fees as well as operational fees such as server maintenance and application hosting. Your donation, according to website, goes first to instead, inc, a registered 501(c)3, and from there the company sends a check to your chosen non-profit.


Select the “Give” button, choose the amount you wish to donate, and even type in what you’re giving up in place of your donation. The app provides a list of charities to choose from, such as The American Cancer Society. You can also suggest an organization to be added to Instead’s database. Submissions are reviewed by a volunteer committee.


Is it easy to set up? This is a lightweight app that allows you to log in with your Facebook account. The app makes a point of stating your donations through Facebook can remain private. However, you can skip that step and proceed without logging into Facebook, too.


Should I try it? Instead encourages you to develop your charitable giving muscle by showing you how easy it is to make small donations from time-to-time by giving up things you likely won’t miss anyway. Your payment, in the end, is processed through your browser, not the app itself, and therefore requires an extra step. If you’ve already sacrificed an impulse buy or gave up splurging on a night out at the movies, however, the hard part is over.

Amazon expands its tablet sights with the bigger, more powerful Kindle Fire HD 8.9. Can it compete against Apple‘s iPad?


If there’s one company that deserves credit for reigniting the iPad competitor market, it’s Amazon. Despite some bugs and an overall blah design, its 7-inch Kindle Fire was the first Android tablet that made sense to consumers who gobbled it up to help the Fire grab 50% of the Android tablet market in just 6 months.

That tablet essentially opened the flood gates for a new set of ever-more-powerful 7-inchers from, notably, Barnes & Noble and Google. All three companies have already updated their 7-inch offerings to more powerful components and higher-resolutions screens. They’re all still running Android, though Amazon and Barnes & Noble choose to hide the Google OS behind smarter and much more consumer-friendly interfaces.


All this led Apple to finally enter the mid-sized tablet space with the iPad Mini. It’s easily the best-looking tablet of the bunch, but also $ 120 more expensive than its nearest competitor.


The more interesting development, though, is Amazon‘s (and Barnes & Noble‘s) decision to go toe-to-toe with Apple’s full-size iPad and launch the Amazon Kindle Fire HD 8.9 (in 4G LTE and WiFi-only). The move is akin to a middle weight boxer putting on the pounds to take on the Heavyweight world champion. Amazon’s Kindle Fire HD is slightly smaller (the iPad is 9.7-inches), lighter (567g vs. 625g), cheaper ($ 369 for 32 GB model vs. $ 599 for the iPad 4th Gen — Amazon subsidizes with sleep-state ads, that I do not mind) and overall somewhat less powerful. In order to win the battle, the 8.9-inch Kindle Fire HD better be pretty nimble on its feet, while able to throw that all important knockout punch.


Short version of this story: the Kindle Fire HD 8.9 does some serious damage, but the iPad 4th Gen gets the decision and retains the tablet leader title.


The Kindle Fire HD 8.9 is by no means a failure. In many ways, it’s as good as the smaller Kindle Fire HD, but throughout my tests I noticed odd bugs and glitches (which should all be fixable by software) and a somewhat disturbing lack of power that’s especially obvious when you put the Fire HD 8.9 next to the iPad 4th Gen


What It Is


If you’ve never seen an iPad and someone handed you the Kindle Fire HD .9, you’d likely say its jet-black, soft-to-the-touch plastic body felt good in your hands and was more than effective at all the core tasks (reading, game playing, e-mail, web browsing).


Design-wise, the 8.9 device looks exactly like the 7-inch model, complete with the too-hard to find volume and power buttons. There are no other physical buttons on this device, but Amazon chooses to hide the few it has by making them the exact same color as the chassis and flush with the body. Every time I use the tablet I do the “where’s the damn button” dance, rotating the Kindle Fire HD round and round until I feel the buttons (since I can barely see them).


I have applauded Barnes & Noble for putting the physical “N” home button right on the face of their Nook HD. Bravo for having the guts to do this. Amazon apparently looks at Apple’s iPad home button and thinks to have anything similar would be seen as “copying” the Cupertino hardware giant, when instead they should realize that it works, consumers like it and tablets without it are at a distinct disadvantage.


Amazon’s interface has you make do with a virtual, slide-out home button that is always available. Problem is, I found times when it wasn’t available. When I played Spider-Man and Asphalt 7, the tiny little left-had bar would disappear and I couldn’t exit the game unless I hit the sleep/power button.


The rest of the Kindle Fire HD 8.9′s body is solid and unremarkable (if you read my Kindle fire HD 7 review, then you know exactly what to expect.). Like the iPad 4th Gen, the Kindle Fire HD 8.9 has a front-facing 720p-capable camera. It’s useful for capturing video, snapping 1 Megapixel images and, probably most important, Skype video chats. Skype has built a fairly sharp-looing Kindle Fire app, though the design doesn’t fully fit the larger 8.9-inch screen. Skype just updated its Android app for better tablet viewing and hopefully, we’ll see this update hit the Kindle Fire HD 8.9 as well.


The iPad also has an HD rear-facing camera. The Kindle fire HD 8.9 does not (Barnes & Noble leave out cameras altogether)


Not Packing a Punch


As a large-screen high-resolution tablet (though iPad’s 2048×1536 retina display beats it), the Kindle Fire HD 8.9 offers plenty of attractive screen real estate for web browsing, book and magazine reading and games. But the results can be mixed. Silk, Amazon‘s custom web browser, was occasionally less than responsive and games, though, they ran well, never looked half as good as they do on the considerably more expensive iPad 4.


Granted, you can’t always find the same high-quality immersive action games on both Android and iOS, but Asphalt 7 Heat is a notable exception and it throws the performance differences between the two tablets into stark contrast. Game play is equally responsive on both platforms: the Kindle Fire HD 8.9’s accelerometer reads my moves just as well as the iPad.


The graphics on the Kindle Fire HD, however, are reduced to blobs and blocks (palm trees without distinct leaves, buildings without discernible windows) . The iPad’s quad-core graphics simply overmatch the Kindle Fire. I have never, for example, seen an iPad draw the game as I was playing, as I did when I tried out The Amazing Spider-Man.


Additionally, I experienced more than my share of crashes with games and even magazine apps like Vanity Fair.


The Good


Not everyone, however, will compare the Kindle Fire HD 8.9 to the iPad. Some will see the $ 299 entry-level price point (for the 16 GB model) and appreciate the power, flexibility and utility of this device. Like all Fire’s before it, the Kindle Fire HD 8.9 makes it easy to consume mass quantities of content. Nearly every menu option: Games, Apps, Books, Music, Videos, Newsstand, puts you just one click away from shopping for fresh content. If you have an Amazon account (and who doesn’t) your desired book, music or movie is just a click away. Plus, you can still easily store any of it locally, and worry about running out of storage space, or in the cloud, and never worry about space or accessibility—you can get to that purchased Kindle content from any Kindle app or registered Amazon device.


Watching movies on the tablet is a pleasure. I streamed a couple through Amazon Prime; they looked good on the 1920 x 1200 screen and the Dolby Stereo speakers produced sharp, loud, almost room-filling sound—an impressive feat not even the iPad can match.


The Kindle Fire HD 8.9 also includes a mini-HDMI-out port, which prompted me to connect the tablet to my 47-inch LED HDTV so we could watch Disney’s Brave. Yes, I had to get up and tap on the Kindle screen each time I wanted to pause and restart the move, but otherwise, I was pretty impressed with how the Kindle handled the task.


Obviously I yearn for an Apple Airplay-like feature on Android tablets (rumor has it one is coming), but this is the next, best thing.


There isn’t a lot to say about the Kindle Fire HD 8.9-inch interface that I did not say in the Kindle Fire HD 7 review. I will note, however, that the increased real estate makes the trademark task carousel seem almost too big. Icons for everything from your recently played Spider-Man game to magazine apps, books and Web sites all sit side-by-side-by side. Some, like book covers, look gorgeous.


Others like a broken web-page link look stupid. Worse yet, none of them have labels, which can occasionally make it hard to identify which app or task you’re looking at. I’m just not sure this interface metaphor is sustainable.


Personally I prefer either the clean consistent look of iOS, or the uber-user friendly, family-oriented Nook HD profile-based one. Amazon may want to take a hard look at those and start over.


Staying Connected


The Kindle Fire HD 8.9 is also Amazon’s first cellular-based tablet. That fact puts it even more squarely in competition with the iPad (which obviously has always had 3G models and now offers blazing fast 4G LTE ones as well on all major carriers).


Amazon’s mobile broadband plans are a little more conservative, with just the AT&T 4G LTE option (the 32 GB 4G model that I tested lists for $ 499, which is still $ 224 less than a comparable iPad 4th Gen).


In my experience, the connectivity is superfast and fairly ubiquitous. Amazon‘s $ 49 (a year) flat fee plan is attractive, but with a cap of 250MB per month of data, it’s unlikely it will satisfy the most data-hungry users. If you do need more data, users can also get 3GB and 5GB data plans directly from AT&T on the device.


At press time, Amazon had not enabled streaming video over LTE. Having it sounds nice, but even with the most generous data plans, streaming video would eat it up faster than you can say, “I’m streaming Back to the Future in HD over 4G LTE on my Kindle fire HD!”


The reality for most users is that WiFi is plentiful and you’ll be hard pressed to find a spot where you can’t connect for free or a small one-off fee. It’s the reason Barnes & Noble’s line of HD Nooks do not include a cellular option.

Perhaps the best new addition to the Kindle Fire family is not a piece of hardware or new component, but the new FreeTime app. Amazon put a lot of loving care into this parental control interface, but almost mucks the whole thing up by hiding the tool under an app that you have to scroll down to (or search) to find. By contrast profiles and age and content controls are baked into the Barnes & Noble Nook HD in a way that makes them impossible to ignore.


Even so, once you do access FreeTime, I think you’ll be pleased with the level of control it gives you. I added test profiles for my two children and then hand-picked every app and piece of content they could access. I was also able to block broadband mobile and even set time limits for access to content and overall screen viewing time (on a per profile basis). The set-up is a bit wonky and it bizarrely switches between landscape and profile screens, but I still applaud the effort. It would make sense for Amazon to move FreeTime into a device set-up screen. If the user has no additional family members or kids using the device, they can easily skip it.


To Buy or Not to Buy


Amazon’s expansive content and shopping ecosystem has always been a strong draw and it’s just as good in this large screen tablet as it was in the very first Kindle Fire. Still, you have to compare it with the equally strong iOS ecosystem, which is no slouch in the content shopping department. Apple doesn’t connect you as seamlessly to physical products, but there’s nothing difficult about shopping on Amazon.com via your iPad. It’s also notable that tablet competitor Barnes & Noble has added movie and TV viewing, rental and purchase.


Ultimately, all of these tablets are offering more and more of the same content options, apps, and features. The decision will likely come down to price, app selection, interface and overall ease of use. The Amazon Kindle fire HD 8.9 scores well on all of these, but does not always lead.


For the price, it’s a great value, but I want Amazon to focus on hardware and interface design for the next big update. Then, they may get my full endorsement.

Microsoft vs. Google trial over patents finishes up
















SEATTLE (Reuters) – A Google expert witness testified on Tuesday that Microsoft will make roughly $ 94 billion in revenue through 2017 from its Xbox game console and Surface tablet that use Google‘s patented wireless technology.


Michael Dansky, an expert for Google‘s Motorola Mobility unit, testified on the last day of a high stakes trial over patents between Microsoft and Google in Seattle. The $ 94 billion figure he cited also includes a wireless adapter that Microsoft no longer sells. It was not clear how far back he was counting past revenues.













Microsoft declined comment on the figure.


The week-long trial in a Seattle federal court examined how much of a royalty Microsoft Corp should pay Google Inc for a license to some of Motorola‘s patents. Google bought Motorola earlier this year for $ 12.5 billion, partly for its library of communications patents.


Motorola had sought up to $ 4 billion a year for its wireless and video patents, while Microsoft argues its rival deserves just over $ 1 million a year.


If U.S. District Judge James Robart decides Google deserves only a small royalty, then its Motorola patents would be a weaker bargaining chip for Google to negotiate licensing deals with rivals.


The rapid rise of smartphones has sparked an explosion of litigation between major players disputing ownership of the underlying technology and the design of handsets.


Apple Inc and Microsoft have been litigating in courts around the world against Google and partners like Samsung Electronics Co Ltd, which use the Android operating system on their mobile devices.


Apple contends that Android is basically a copy of its iOS smartphone software, and Microsoft holds patents that it contends cover a number of Android features.


In return, Motorola and some other Android hardware makers launched countering legal action.


Before trial, Robart said testimony about patent license agreements between Microsoft, Motorola and other tech companies could be disclosed to the public, along with other sensitive financial information.


However, the judge reversed himself this week and said he was bound by appellate precedent to keep that information secret. On Tuesday he cleared the courtroom and heard two hours of testimony in secret.


During the open session, Dansky said Motorola‘s video patents are crucial to Microsoft and other tech companies, and deserve a high royalty.


“You will have a difficult time selling smart phones or tablets,” Dansky said, without Motorola‘s technology.


Robart is not expected to release a ruling for several weeks as both companies must file further legal briefs.


The case in U.S. District Court, Western District of Washington is Microsoft Corp. vs. Motorola Inc., 10-cv-1823.

N.Y. police officer says not guilty of plan to cook, eat women
















NEW YORK (Reuters) – A New York City police officer pleaded not guilty on Monday to conspiring to kidnap, torture, cook and eat women.


Gilberto Valle, 28, of Forest Hills, Queens, was charged and arrested in October with conspiring to cross state lines to kidnap the women and with illegally accessing a federal database.













Prosecutors said some of the women were acquaintances of Valle but it was not clear if he knew or had met all of them. Valle, who an official said had no prior criminal record, was not charged with carrying out any of his suspected plans.


At a brief hearing Monday in U.S. District Court in Manhattan, Valle’s attorney, Julia Gatto, told the judge she would again seek to have her client freed on bail after two other judges previously denied her request.


Investigators uncovered a file on Valle’s computer containing the names and pictures of at least 100 women, and the addresses and physical descriptions of some of them, according to the criminal complaint. It said he had undertaken surveillance of some of the women at their places of employment and their homes.


Gatto argues that Valle, a 6-1/2 year NYPD veteran, was all talk and should be released on bail.


The charges carry a maximum sentence of life in prison.


The case is U.S. v. Gilberto Valle, U.S. District Court for the Southern District of New York, No. 12-cr-847.

Wii U Launch Day: Everything You Need to Know
















For Nintendo fans, the big day has arrived. Nintendo‘s newest console, the Wii U, began selling at midnight on Sunday morning across the United States.

The Wii U boasts high definition graphics and an innovative, new tablet controller called the GamePad. The GamePad can act as a second screen, either mirroring or displaying asynchronous content from the console. The GamePad can also function without the television even turned on.


Nintendo hosted a launch event at its Nintendo World store in Rockefeller Center in New York on Saturday night. Some fans had been lined up for a week or longer to pick up a console, and as the countdown ticked down to midnight, the line wrapped around the building. The event was attended by Nintendo of America President Reggie Fils-Amie, who addressed the crowd, as well as other Nintendo executives.

But demand for the console may not reach the insatiable levels of the 2006′s Wii launch, which sold out in stores across the country preceding the holidays. At 11:30 a.m., a Nintendo World employee said they still had consoles in stock, though there was a line of 30 people outside. Mashable was able to pick up a Wii U in a Brooklyn Target with no lines at 9:30 a.m.
